Improperly Forced to Yard

 The Claim:

• When forced from a road to a yard assignment due to being junior Remote Control Qualified, while junior non-qualified employees are allowed to work on the road.

• YOU MUST MAINTAIN BIDS TO RETURN TO THE ROAD AT YOUR FIRST OPPORTUNITY.

REQUIRED DOCUMENTATION:

• A copy of the seniority roster

•  Job histories demonstrating an equivalent number of junior employees being allowed to work road assignments, as would allow you to hold the road otherwise.

• Bid history showing date of bid to leave yard service.

REQUIRED CLAIM LANGUAGE:

Claiming lost road wages from (date to date) from the    (circ and job ID) in addition to all other yard earnings due to improper restriction of seniority. On (date)   I was forced to the circ-7 job id yard assignment from the (circ-) (job id) road assignment. Senior employees,    (forced employee name ) , and (forced employee name) were also forced to the (circ-7) yard. Junior employees    ( name 1)   (name 2) and (name 3)   have been allowed to remain on road assignments. Per Section 3 of the 2002 National Remote Control Agreement, "all employees are to be RCL qualified".
