YOUR CLAIM:

• When your call is broken prior to performing service, whether on duty already or not, you are entitled to 65 miles. PLB 3736 Award 4 held that an employee, having received a call, and then subsequently released, is entitled to be paid for the call and release, time of day not a factor. 

REQUIRED DOCUMENTATION:

• Call log showing being called for service

• Work History showing called for service and released prior to performing service

• Timeslip, if call broken after on duty time. 

REQUIRED CLAIM LANGUAGE:

Claiming 65 mile penalty account being called and not used in accordance with Rule 41 (d). Called at ____ hours with an on duty time of ____ hours on __/__/__ for the ___(train ID)__. At _____ hours, I was notified that my services were not needed. Claiming 65 mile penalty in accordance with PLB 3736 Award 4.
